hello friends...please be noted that the duration of employment with the company is not mentioned in the clause. Please read it carefully... its says that WHENEVER you leave the company, you will have to pay any training costs that you have availed in previous 12 months.
So tis means that if I decide to leave the company after 3 yrs of employment with them then also this clause is applicable to me.
Please advise me....should I sign this contract or not?

I applied on May18 for I-140 and will be applying to I485 soon.. and would get EAD...so what happens to EAD and AP...I cant beleive they are
waste..Probabaly people with pending I-140 will be subject to the new systems..??..what do you guys think??..Its not pratical to drive people down the Queue again..

INA 202 (a) (3)
�Exception if additional visas available. - If because of the application of paragraph (2) with respect to one or more foreign states or dependent areas, the total number of visas available under both subsections (a-Family category) and (b-Employment category) of section 203 for a calendar quarter exceeds the number of qualified immigrants who otherwise may be issued such a visa, paragraph (2) shall not apply to visas made available to such states or areas during the remainder of such calendar quarter�.
Therefore, the 7% country cap had always been �soft� till year 2000.
After year 2000, AC21 has completely removed country cap in each employment category, if excess visas are available in each preference categories.
After 2000 (After AC21) the following law was added to INA in the section 202.
INA 202 (a) (5) (A)
EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter.
The devil is in the details....What do they determine during the year that there are additional visas available ??? In that question lies the whole issue...
The state dept. would not give the number usage statistics until the year has ended..The laws say something...the Babus in Washington interpret it in their own way and donot explain anything....How do you make them tell their interpretation ????

In fact, we'll probably see you or your kids standing in line for an Indian or Chinese green card in a few years (and I doubt India or China will focus on diversity when it comes to attracting the most skilled talent).

Look back and recall the time when you told yourself that if you ever made it to the US, you are going to visit place A or do thing B. Go kayaking, enjoy the countryside, join a hiking group, play some sports and etc. US have lots to offer us if we just let go and start enjoying life. Good Luck!!

Anybody Travelled with only Advance Payrole through Frankfurt recently please post ?
where they will check for transit visa in usa while boarding or in frankfurt or in india while return ?
My nationality is Indian. Presently i am residing in USA . I have " Advance Payrole Document " . I am planning to travel in this February 2011 from " Atlanta -> Frankfurt -> India(Hyderabad) " and return is in May 2011 from " India(Hyderabad) -> Frankfurt -> Atlanta " in lufthansa airways.
So shall i go for this round trip with a valid " Advance Payrole Document " only ? or i need to have " Air Transit Visa ? If i need Air transit Visa could you please let me know how to apply and what documents i need to submit .

Kinkos is horrible!!! I went there this morning and had to wait 40 minutes for my photos and when they came back they had a greenish tint and the colors were all washed out. They looked like a two year old photoshoped them :D Clearly they would have been rejected by immigration so I asked for my money back.
I then went to Sears and they did a great job. They have professional studio equipment and all it took was 5 minutes and I had all my copies looking great like they're supposed to.
So... Sears, highly recommended. They charged me $61 for two sets of 8 photos for me and my wife which is the same price as Kinkos or CVS & Walgreens, less the horrible amateurish quality.
I took the first set of photos in Walgreens, but the background was not clean although plain white.. they was a very light spot in center of the photo, although not obvious, when asked I was told thatz how the background screen is and all photos they take are the same and they showed me few samples. I was not happy and drove straight to Sears and the photo I took came out pretty good. Same or better than the samples in the link below

Hi All FP seekers! I do not know what exactly I am missing if there is a delay in FP. It looks like hundreds of IV members are too much worried because of the 'delay' in FP. Let me worry too (by knowing the big problem!). Can any worriers explain??
On the other hand is it not better to have a late FP, so that you need not go again in the next 15 months! Anyway for most people GC is going to take years!
It's the uncertainty of the entire process that kills us...Have seen couple of users whose cases have been erroneoulsy denied since they did not went for their biometrics. Guess what, these users never received any FP notice from USCIS. I tend to partially agree with you; if the PD is no where close to being current, why worry about FP now - it's their responsibility to get us finger printed. But on the other hand, I do not want my case to be erroneously denied because of an error in their processing...
This is just my personal opinion. I am not loosing my sleep over this any more.

Considering the current economic situation, i donot expect much progress in addressing country quota elimination/CIR's.
We should atleast try to get our issues addressed in bits and pieces. Overall, anything to address retrogression should be welcomed! rather than 'debate and beat the horse to death.'

I might be wrong, but I think the way it works is by supply and demand. If the supply of new visa numbers is much less than the demand, the dates might go back.
They worked enough for this year and they have lot to do. According to my guess they have the following pending work.
1. Issue Receipts (Sep/October)
2. Issue EAD cards for approx 300,000 applicants? (October/November/December)
3. Issues AP for 300,000 (October/November/December)
On top of this they need to celebrate thanksgiving and christmas like every citizen. So don't expect too much from them for this year.
If at all there is some momement in EB numbers, that will happen only between Jan-March(before H1-B madness starts).

We don't even advocate for anything, just post things on the forum. IV has given us immigrants a platform - many of us don't even know it, let alone using it.
If we want to stay in this country, we need a president who can take this country progressively to the future instead of "lets take the country back" "this is not the country I grew up in" rhetoric! If this country goes backwards in time while the rest of the world embraces progress - guess what? - No use having a GC here.

For EB3, 16 days are not significant. But what is significant that there were many 245(i) cases. Around 26,000 alone from April 26 to April 30. So crossing that barrier is a significant move.
While this generates some hope, one should note that PBEC and DBEC are giving ads most of which in high probability 245(i) cases. Does that mean while labors are being cleared, dates have moved without taking into account that when recruitment instructions are done for such cases, they will be in the queue. If that happens, EB3 instead of moving forward will move backwards.
Not a pessimitic view, but based on logic.

Applied to TSC on July 23rd, got a transfer notice on Sep 28th. I applied for I131, EAD/I485. My Checks got cleared. My EAD/AP receipt still says CA, but I think they are sending I485 to original I140 apporved center ...for me TSC.
