    I'm going to say this once more. As much as we try, we cannot bring the Indian community under one umbrella to act together. It's a pipe dream and not achievable. I've experienced every possible Indian specimen there is in the Bay Area. Indian community in US can NEVER be like the jewish or hispanic community. What we need is representation in the corridor of power (AKA Congress/ Senate), period. No number of phone calls from mere mortals like us will equate to one phone call from big-wigs such as Vinod Khosla or Indra Nooyi.

    If you are wondering if I have done anything, here's my contribution.

    I approached the CEO of my company to raise my concern. My CEO was graceful and said that the government relations team in my org was already working in Washington D.C to address retrogression issues. I was given an internal point of contact who briefed me on the effort. Call it their need or greed, the "white man" seems to be more helpful in this regard.

    There is no "single best strategy" - Microsoft's Ex-Chairman has testified to the Congress many times and it has been well covered in the media.

    Your efforts are very well appreciated. There needs to be multi efforts, IV's efforts being just one of them. There is no stopping people to take initiatives at the State Chapter levels. What we need is more motivated leaders like Pappu, Logic_Life, Aman, Paskal, NeedHelp!, ...................., and a lot of support from common people like us ............

    This is a very valid point. If employer or his lawyer asks more money in fees for filing I485 it is always better to go thro employer if he files I485 promptly. But if the delay is intention of the employer then use your own Lawyer.

    Desi companies - HIGHLY ADVISABLE TO USE UR OWN LAWYER AND DONT LINK LAWYER AND EMPLOYER - THEY HAVE TENDENCIES TO BECOME BUDDIES BASED ON BUSINESS PROMISES.

    TAKE ALL DOCUMENTS FROM EMPLOYER AND GIVE TO LAWYER. U MAINTAIN UPPER HAND WITH LAWYER.

    485 RFE IS COMMON FOR EMPLOYER- LAWYER COMBO OF DESI COMPANIES.

    Lawyer needs money and employer needs prolongation.

    With rules changing and with CIR reintroduction and with Durbin Grassley amendments - Desi companies will be having tough business in future - they will try to retain consultants in whatever way possible. So beware. These people are sweet in their talk - but they do everything opposite to what they talk.

    This maybe applicable to non desi companies also - this dates becoming current is an acid test for employer's genuinity.

    So be cautious - watchful and get things done in smart way. 180 days down the lane the story is different.

    May i know when was your last fingerprint done, my PD is Aug 2003 and i had finger print done long back so do they need to do the fingerprint gain before approving?

    I gave type 2 Fp in 8/2006
    All fingers this year March again

    Welcome to IV and Thanks for sharing your ideas.
    A concept will be put to test by how it is received by all others in the same boat. Whether it is accepted or not, pls remain with IV.
    Do not be discouraged by a critique - most have merit.

    Become a donor - any effort in this country needs money.
    From current sentiments floating amongst general public, donation for attention may look like a buyout attempt.

    Reasoning with the right people in proper limelight is the strongest way.
    The system is unfair to folks who have done things by the book.
    To change it, in this economy is not easy. IV has put in tremendous efforts in the past.
    Let us just not give up. Big names in Industry and rational voices in TV are slowly opening up to what we are facing.
    But this is not our country. Let us be prepared to convincingly answer: Hey, don't like it? Go back to where you came from.

    Still I disagree my friend. I know, law is the law! What I am disagreeing is your interpretation and conclusion.

    In reality, towards the end of the Fiscal year, if USCIS/State Dept finds that visas will go unused in one category, they can use the spill over rules. So, if there are some potential unused visas in Family category they can add it to Employment category and vice versa. This will all work in the same year. It will not work or get transferred to a following year. In your initial argument, you said, because all the family visas for 2008 are completely used, we won't get anything from that category as spill over during this year (2009).

    If your argument is correct, there won't be any need for recapture laws that we all are working for. If the unused can be given to the next year, no visa will get wasted. USCIS/DOS can just give the unused in family category to Employment category in the following year and vice versa.

    In reality that is not the case. Visa number in one year will not flow to the next. So, your original argument is completely wrong. If there is nothing left in family category for the year 2008, that has nothing to do with the expected spill over to Employment category from family category in 2009.

    In my opinion, law is complex and snippets of the law from here and there won't will not clarify anything. So, if anyone would like to be optimistic, stay there, to be pessimistic, stay there - this whole argument by MPADAPA is not enough to change your state of mind :) Just my observation!

    guys cool down it took them till end of May about 2 months to issue all receipt notices for H1 filed on Apr 2 this year. With the whole yes-no-yes situation this month they are definitely backlogged. Lets just wait till we actually get the receipts .

    Really good point.

    Everybody say that the 90 % of the american are against illegal, i don`t know, but it look really strange to me, due that everybody use illegal to clean the house or delivery food. I really think that american people are scared about high skilled immigrants that can really harm their job, i feel it everyday in my office. That is reason for my pessimisme. Nobody cares about an housekeeper or a delivery guy, no americans what to do that. By the way, my friends, from England, got a green card in two years. How could it possible?

    Senetor Lautenberg mentioned "Under current immigration law, employment-based immigration is limited to 140,000 visas, or green cards, per year. The process for obtaining employment-based visas can take years to complete, causing many of these visas to go unused. There is also an annual per-country limit that caps at seven percent the number of employment-based immigrants that can come from any one country. In some instances, this per-country cap causes employers to consider country of origin, not talent, when hiring foreign workers.

    A bill has been introduced in the Senate that would address some of these delays and caps. The �Reuniting American Families Act� (S. 1085) would recapture unused employment-based visas from prior years. This bill would allow the Department of Homeland Security to issue any unused visas from Fiscal Years 1992-2007 and in the future roll over any unused visas from one year to the next. It would also increase the per-country cap for employment-based visas to ten percent of the annual total."

    It seems that Senator Menendez is doing a lot of work to bring relief to all immigrants including employment based. It may be brought in the lame-duck session in December.

    Hi all,

    Mine is a different situation, i was with my employer till mid of last year and did not inform him while leaving his company and joined another job (h1 transfer) he is now saying that the vendor did not pay him some money and i have to pay that amount and he is demanding that amount for my W-2.

    He also said that he would take legal action if i didnot pay his losses ( i did not sign any document with him other than my h1b papers) no agreements,

    I am going to call IRS after feb15, but is he going to go to court?

    Please suggest me.

    Dude, I think you shouldn't worry about this. The contract was between the consulting company and the client. If the client doesn't pay what is your fault ? You don't control the client. I don't think he has any case against you. He might have a case against the client for not paying the dues for services rendered but that is their problem , not yours.

    These desi consulting firms are so friggin shortsighted and pennypinchers. They need to be taught a lesson. I really wish that they come up with some immigration reform bill where one of the items is to prevent exploitation of employees hired by these desi firms.

    Its a good thing, hope this will lessen the abuse of the visas by these Indian companies. As I mentioned in another thread, I have seen that H1 and L1s who come from India dont get a very good salary. Not good.

    If your COS application was approved and you didnt have to go out of US for H1B stamping I would assume your are in status.

    I dont know if this would come up in RFE or at interview stage, but I wont worry about it unless the period was more than 180 days.

    Sent letters to WH and IV. Besides, I printed 100 copies of the original template and kept them in an Indian grocery store, with the permission from the store owner, although it took a long time to explain our situation to the owner of the shop.

    I see there is a lot of discussion about how one day GOI will have an agreement with US Govt and we will all get benefits of all social security taxes paid. I don't see that happening because India doesn't have a social security system! US does have social security agreements with a lot of countries but those countries have social security programs. US transfers credits and the other govt has to take care of the details. Also, these agreements are always bilateral. India would have to offer some sort of social security or something in return to US nationals working there. I wouldn't get my hopes high about getting social security money if you leave the US before getting 40 credits. In fact even if you do gather the credits ... by the time you become eligible in 30 years things could be drastically different and you may not get a single penny out of it.
